Another mini-drama in South Africa: The court has refused to release Rav Eliezer Berland to house arrest.

One of the Rav’s aides who was present at the court session told Bechadrey on Thursday, “We heard the news in total shock. At a session last week, the court accepted the claim of Rav Berland’s attorney Anthony Katz who proved to the court that Rav Berland’s detention was illegal. The session was fraught with tension, but optimistic. It’s not clear what will happen now. Now they are consulting with the Rav’s attorney to decide if they should appeal this decision or not.”

Last week Bechadrey reported that a deliberation was held on the question of whether or not the head of Shuvu Banim could be released to house arrest in Johannesburg. The prosecution claimed that this was dangerous because of the chance of the Rav fleeing, because of the incident that happened in Holland. They demanded that the Rav give guarantees that would ensure that he would not flee the country.

The prosecution even claimed at the Rav’s judicial session last week that his Visa card has expired and so the Rav has no way to purchase an apartment – and to be released to house arrest he must have an apartment deeded to him. The Rav’s attorney said that a solution to this could be found.
