Avrech sentenced earlier this week before a military court, convicted of being a deserter and sentenced to 35 days.

Schneier Kanelsky, a Chabad Hasid 22.5 year moved two and a half years ago to live in Moscow, where he married last year , and his wife is due to give birth in the coming days .

Before Pesach, he returned to Israel with his wife to stay at his parent's home in Kiryat Malachi. But only after he landed, he realized that he could not return home, since he had not adjusted his status in the IDF.

After Pesach, he stood at the recruitment center in Tel Hashomer , and expressed his desire to enlist, pointing out that the intention of his wife, a Russian citizen, is to immigrate to Israel and to live in the country.

But he was arrested and jailed at Zrifin 4, and brought before a judge. Prosecution demanded imposition of Schneier to 150 days in detention, but the judge did not agree to this, and demanded that the parties will reach a plea bargain.

"The judge understood that such a person should not be locked up for so long," says his father Avraham Kanelsky, known activist in Kiryat Malachi, "she claimed repeatedly that the Haredim want to enlist and now comes an Orthodox and wants to enlist, it makes no sense that he be detained for so long."

Avraham added: "The judge spoke her mind and said that she would not send Schneier into jail even for a day, and would send him immediately to enlist."

According to his father, on Sunday, the parties reached an agreement whereby Schneier will be 35 days in detention, and the judge recommended that he be transferred from prison 4 to prison 6, since there is no Kosher food.

His wife, actually began the process of immigration to Israel, returned to Moscow to regulate her matters, and yesterday (Tuesday) returned to Israel and went through the naturalization process.

At the same time to her arrival, her husband Schneier was transferred to prison 6, and since then eats no food except bread and water.

"I spoke today with Lieutenant Colonel Eli Adar, Military Ombudsman , and asked how they can hold a prisoner without giving him kosher Mehadrin food and what he eats and drinks is just bread and water ," says the father , but to his surprise , he responded : "He also has Certified Kosher Mehadrin ketchup . "

According to Lieutenant Colonel Eli Adar, he promised to endeavor to provide starting tomorrow kosher food, and not have to hold the subsystem "grain of salt and water sparingly drink."

"Schneier's wife had not seen him since he was arrested," added the father. "While the military court hearing she was in Moscow, arranging immigration and she is due to give birth in the coming days."

IDF Spokesperson's response was not received. When it is received it will be published.
