Jerusalem police arrested two youths this morning putting up posters against the Pope. Among other things written on the ads: 'Quit to impure our holy land', 'return the stolen vessels to the Temple'.
Baruch Marzel says that these are legitimate ads and Jerusalem police forgot what freedom of expression is; We will not forget nor forgive the Crusades, the Inquisition and the rest of the grief that Christianity initiated against the Jewish people, the Pope is not welcome in Israel.
Magistrate's Court in Jerusalem, Shmuel Herbst, rejected the police request limit under house arrest for seven days, away from Jerusalem and to impose monetary deposit on the two young men. In his decision, the judge ruled that "the theological debates and disputes between religious existed since immemorial time and there are arguments to be a danger to public safety."
The judge further ruled that: " The only sentence that can be understood that where the slightest touch of incitement to racism is the law: they are Christian's dream of the elimination of the Jewish state. Trial although it can be understood that faint far because Christianity has intentions to act against it accordingly." However, judge hurried to emphasize: "This is suspicion slim, not related to racism and does not meet the restrictions imposed by law as seen from a fundamental principle of the democratic regime and laws. Individual may perform any action that is not defined as the act is prohibited in the State may not take any action other than those permitted her under the law".
Under these circumstances, the judge rejected the request house arrest, expulsion and the imposition of a monetary deposit and held that the right of young people to demonstrate against the Pope and that "should allow the protests requested." In light of the above, the judge ruled that the young will be able to sustain the protest under the law, one hundred fifty feet from the Pope.
Attorney Itamar Ben Gvir, on behalf of Chaneinu says that this is an important decision and principle: "I hope the police internalize the right of young people to hold protests against the Pope, and no place to silence."
Hearing will be held before Judge Herbst.
