President of the Supreme Court, Asher Gronis, announced today (Monday) the postponement of the yeshiva's request to delay implementation of the order prohibiting the State Treasury to fund the yeshiva students whose enlistment was rejected by the Minister of Defense two and a half years.
Recall, the High Court filed two separate requests, first by the Attorney Simcha Rothman, who represents the Yeshiva Knesset Yisrael Elad, and second by Mr. Bezalel Smotritz on behalf of the Zionist Yeshiva Federation, Hesder Yeshivas and Orthodox yeshivas Managers Association.
As mentioned, the Supreme Court rejected the request for a stay of the interim order stating that there is no excuse for now to join the yeshivas as respondents. However, Asher Gronis stated that the left-wing organizations and the Ministry of Finance to respond to the petition until the 17th of the month and explain why the yeshivas were not attached to the petition as respondents.
Two motions filed last week, called the High Court to delay the execution of the decision for a temporary injunction to prohibit the Treasury on budgetary transfers for their yeshivas from the years 94-95 and the first half of the 96th. Decision following which the Finance Minister hailed the budget was supposed to be made more the same day for all members of the yeshivas, despite the court's ruling which touched only a small part of them.
Bezalel Smotritz attorney who filed the petition in the name of the yeshiva union responded and said: "we will wait patiently for the response of the parties. We find it difficult to see a situation where the decision to stop the budget remains intact and are convinced that the court will find the courage and integrity to admit his mistake and overturn the decision. We call the state Attorney to stand with us and join the just and moral demand that the cancellation decision was made without hearing the yeshivas position. "
Hiddush filed the petition, responded to the decision and said that according to the data in their recalculation of allocations have been made , and that the money transfer was rejected by the Ministry of Finance should be made in the coming days and therefore there is no urgency in hearing requests. Decision of the High Court, they say, is total catalyst work of the Knesset.
