High Court decision to stop the budgets for yeshiva students whose enlistment was rejected by the Minister of Defense, caused a stir in the yeshiva world, but veteran yeshiva director seeks to calm things down.
"The Hiddush who petitioned the court claimed that it is ten thousand yeshiva students, but it's not accurate and it's a lot less. Important to note that students in the first lesson of the yeshiva are still defined as twelfth grade high school students, the decision was not concerning them because they are not included in court orders.
"Even the students included in the mentioned case law, still on the list of things depend on accurate criteria of the army would have to provide in order to fulfill the requirements of the High Court. This does not only depend on abstracts alone but also on factors other variables, so that ultimately the decision will be reduced minority should attain the students.
The source added: " The High Court itself notes in its decision that it deals only with students regarding jurisdiction which is doubtful, i.e. as soon as the Knesset passes law that is already on the voting committee worked at the Ministry of Finance will be able to return and resume the budgets for students in their studies at the yeshiva shall be regulated by law.
"Another important point ought to pay attention to is that this is only an interim order. The moment the boy's status is regulated; there is a reasonable chance that the money will be returned retroactively to months ago. Court does not prevent the Ministry of Finance to budget - it just issues an order forbidding currently made transfers. "
Nevertheless mean the same factor, the decision is still puzzling: "Why would the Supreme Court push to issue an injunction regarding such a short time? Is this a practical decision or resolution whose sole purpose is to create headlines? "He wondered.
Another reason indicated by Yahadut Hatorah this morning in the media, is the fact that the budget for February has been moved – and High Court ruled irrelevant to the budget next month , until then as it would have been a new law .
