Who will be new arbitrator in Ponevez conflict? • Initial release

A further and surprising development in the legal saga that accompanies the ongoing succession dispute at the Ponevez Yeshiva: After the district court ordered the Hagr"a Kahneman's representatives that they should go back and finish the original proceedings of the arbitration composition, as published in Behadrey Haredim, they had to find a replacement arbitrator in place of the previous 'borer', Hgr"p l Schreiber zt"l, who died in recent years.

As recalled, Hgr"p Schreiber argued that the continuation of the arbitration proceedings is not valid, and that it ended in the judgment given at that time. While the head of the panel, Hgrh"g Zimbalist, insisted to continue discussions and release 'clarifications', despite his advanced age and precarious health condition.

Today (Monday) , after an extensive search, and after all attempts to find a recognized rabbinical arbitrator, Hagr"a's representatives announced to the arbitrating body that the alternative arbitrator is Mr. Rafi Shayovitz of Ramat Gan, a senior attorney familiar from business arbitration between entities.

Behadrey Haredim learned that many rabbis who have been offered the job, refused because they said that a procedure continued in this way "is not halachic and illegal", Hagr"a Kahneman's people also requested an extension of Harav Zimbalist, to try and find such an arbitrator abroad - but were answered in the negative.

The composition of the new arbitrators is expected to convene in the near future.
