State: coercion will foil conscription law of Yeshiva students

Attorney General warns the Supreme Court not to accept the petitions of secular organizations that require immediate recruit of Yeshiva students

The State warns the Supreme Court that imposing enlistment on yeshiva students could thwart the law on the subject.

As published today (Monday) , the State Attorney's Office has updated its response to the High Court yesterday, to the petitions of Hiddush movement for religious freedom and equality, Free Israel, the Forum for Equal Burden and more, requiring the defense minister to immediately recruit yeshiva students.

The State's response stated that "we are in the last stages of formulating a new constitutional arrangement. In these circumstances, the State's position is that the decision in these petitions at this stage is premature.

"A decision of petitions by way of accepting them at this time, means recruiting yeshiva students in a manner which is inconsistent with the government bill, and in a way which undermines its purposes."

"Recruitment of yeshiva students currently may thwart government efforts to lead to the regulation of the issue, and the failure of the legislative process. The state believes that petitions are not ripe for decision at this time, and that there is room to allow the Knesset to complete the process before it, that with the required caution, it can be said that its is currently reaching its final stages. "

The state's response was given prior to a hearing on the 29.12.13 after Ya'alon announced several months ago that he uses his authority by law and is delaying the recruitment of yeshiva students who have came of age.

The State's response was submitted by attorneys Dana Briskman, Yuval Roitman and Avishai Kraus.
