End of the dispute between the Bobov courtyards?
After almost eight years of discussions and unending battles, yesterday (Sunday) the dayanim of the special Beis Din who discussed the dispute between the Rabbanim, decided on part of the Psak Din which will be released shortly.
Members of the Beis Din who took part in the arbitration discussions are: Hagaon Reb Zvi Berger-dayan in Manchester who was an arbitrator from the side of the Rebbe Hrm"d of Bobov, Hagaon Reb Zalman Gross, an arbitrator from the side of the Rebbe Hrb"z of Bobov and the arbitrators Hagaon Reb Yitzchak Chaim Zletenreich-Ab"d Tshakawa, Hagaon Reb Yechiel Babad-Ab"d Tortikov, and Hagaon Reb Avraham Baruch Rosenberg-Domt"z in Monsey.
According to the Beis Din's decision, which is expected to be published in full soon, since both Rebbes are heirs according to the Torah - and are successors of the Rebbe of Bobov zt"l, they can both use the name Bobov.
About seven years ago, In Iyar תשס"ה, the side of the Rebbe Hrb"z filed a lawsuit against the side of Hrm"d of Bobov, in which the community sought court injunction against the competitor, so they will not be able to use the name Bobov.
Yesterday the court decided to dismiss the case and ruled that the two sides can continue to be called Bobov.
So far, the two communities have used the name 'Kahal Shaarei Zion' named after the Rebbe Rabbi Ben Zion of Bobov hy"d, the Kedushat Zion. But from now on there is a change in the matter.
Under the agreements, the dayanim will write the psak din, that the use of the name Bobov, Side A (Hrm"d of Bobov) will add for the sake of peace and signature, the number 45 after writing Bobov, as is the case today that the two courts are called by the people, Bobov 48 (Hrb"z of Bobov) and Bobov 45 (Hrm"d of Bobov), after the name of the street where the Beot Midrash is located.
It was also decided that the congregation of the Rebbe Hrb"z of Bobov is entitled to hold the name 'Kahal Shaarei Zion', as in the past. However, the Rebbe Hrm"d of Bobov, will be named in the future, 'Kahal Shaarei Shlomo' after the name of Rabbi Shlomo of Bobov zt"l.
The Beis Din has not yet issued its ruling in writing. In the coming period the extended judgment will be given, after the discussions which will include reference to the assets - a loaded and deep controversial issue - and, as noted, the issue bearing the name of Bobov.
