Yeshivas Nechalim will reimburse a teacher at 150 thousand shekels

The teacher, Dina Fisher, claimed that her dismissal was part of her Russian origin • The court accepted the argument, and the institution were forced to pay a compensation of 150 thousand shekels, and court costs - 15 thousand shekels

Yeshivas Nechalim will reimburse a teacher at 150 thousand shekels

Dina Fisher, 56, was a Tanach, Judaism and History teacher for eight and a half years at the Yeshivas Nechalim. In a lawsuit filed by the Regional Labor Court in Tel Aviv, she claimed that she was fired from her job because of her origins (FSU). The court ordered the yeshiva to pay her compensation of NIS 150,000.


Fisher was employed by the institution following her appeal – in which she suggested to the school board to establish a study trend that will be directed towards immigrant students from the former Soviet Union. She brought with her a 'dowry' in the form of a group of students from these countries.

Upon her acceptance for work in the institution, Fisher did not have appropriate education, according to the Ministry of Education, as a condition of teaching in the humanitarian subjects. 4 years after starting to work at the school Fisher completed his master's degree in Jewish Studies at Touro College in New York.


Over the years, she began teaching the humanities in the classrooms whose population was not based on students from the former Soviet Union, and included native students or students from other countries.

After eight and a half years of work, Fisher received a letter of dismissal. "Your dismissal from work is a result of a decrease in the number of students from the FSU in school and closing of the cooling and air trend," reads the letter she received.


Fisher did not accept the dismissal notice, and tried to turn to the institution. When her demands did not help, she turned to the Beis Din with an application for a temporary injunction, ordering the cancellation of her dismissal, since they prove unacceptable discrimination against her race. The institution did not address the claim and did not attend the hearing which decided that a temporary injunction for the cancellation of her dismissal will be issued. Later, Fisher filed a claim for contempt of court and therefore the institution filed an answer and a request to cancel the order.

At one point the Beis Din asked the opinion of the Ministry of Education who stated that Fisher could teach subjects like music, but not the subjects she used to teach at the institution - because she does not have the education for it. For this reason, the Beis Din dismissed the temporary order.


Consequently, Dina Fisher filed a claim statement which petitioned for an injunction to enforce the labor relations. She brought the lawsuit claims that the dismissal is made in the absence of a hearing, and they suffer unacceptable discrimination.

This week, a judge at the Regional Labor Court in Tel Aviv ruled that the institution will have to pay a total of 50,000 shekels for non-monetary damages, for breach of the provisions of the Equal Employment Opportunities and unlawful dismissal, a total of 100,000 shekels for monetary compensation for loss of earnings, and the sum of NIS 15,000 for the court costs.
