The Court: Avrech must to work to support his family

The Family Court in Ashdod forced a yeshiva student to pay temporary child support of NIS 2750 per month to his ex-wife and one year old infant child, although he claimed that he learns Torah and is able to pay only NIS 1400 per month, reports Globes.


The life of the couple faced a crisis, "due to lack of coordination and temper of both," says the discussion protocol. "The petitioner alleges that she thought she was marrying a Torah illui, revealed a lazy man, whilst the respondent argues that he indeed devoted himself to religious studies, and produced letters from rabbis on this issue. Each side attaches to the other features of aggressiveness, rude, verbal and physical abuse.

In the lawsuit, the woman who is pregnant with her second child, demanded, to get from him temporary support, as follows: minor needs – 4,550 per month, her own needs – 4,180 per month, expenses and maintenance – 3,508 per month.


The father argued that because he is an avrech, he can pay child support of 1,400 shekels a month at most. The father also argued that there is no award of alimony to the woman in light of the potential salary, and the fact that she had abandoned him, and that there is no place for residence, since she and their son live at her parent's home.

The court stated: "It would be appropriate that the respondent set out for work to support his family, and set aside time for Torah study, as do many others. As a young man, he is healthy and capable, to able to earn at least minimum wage, which is currently of about 4,300 per month."


In light of this the Beis Din ordered a sum twice the amount the father declared he has in his ability to pay.
