Hgr"a Kahneman demands: to depose of Ponovicz arbitrators

Hgr"a Kahneman, president of the Ponovicz yeshiva, recently contacted the District Court in Tel Aviv to order the dismissal of arbitrators in the prolonged conflict between him and the other side of the yeshiva, headed by his brother in law, Hgr"sh Markowitz - claiming that no true arbitrating took place between them, according to a report on Calcalist.
According to the request, in 1999 the parties signed a bill of arbitration and the decision was made a year later. However, according to the Hgr"a Kahneman, it did not end the conflict. Rabbi Kahneman argued that after the decision - he found that two of the three panel arbitrators, Rabbis Zimbalist and Heisler, act contrary to the basic obligation. He also discovered that they act in coordination with Hgr"sh Markowitz for additions, clarifications and opinion changes.
More recently, according to Rabbi Kahneman, he found that between Rabbi Zimbalist who was appointed to be Av Beis Din and Rabbi Markowitz there is a direct connection, which was hidden from him, in which the two held personal consultations in matters of arbitration.
In his letter to the court Rabbi Kahneman noted, that since the decision in 2000 and for several years the conflict was brought before Hgray"l Steinman, depending on the determination of the gedolei hador - and the parties acted in accordance with the decisions.
However, to his surprise, Rabbis Zimbalist and Heisler, apparently in agreement with Rabbi Markowitz, returned to arbitrate the dispute, after there was no arbitration hearing before them for 13 years, and began to discuss the demands of Rabbi Kahneman against Rabbi Markowitz.
Rabbi Kahneman says that he had no choice but to ask the court to order the removal of the rabbis Zimbalist and Heisler from their role and the appointment of other arbitrations. Along with this request, Rabbi Kahneman filed an application for a temporary injunction of the ex party, which prohibits arbitrators from holding any discussion of arbitration, including not holding the arbitration hearing set for Wednesday this week.
The representative's response of Rabbi Shmuel Markovitz, Attorney Boaz Pyle from the firm of Yigal Arnon & Co., as reported to Calcalist: "This is a link in the chain of proceedings taken by Rabbi Kahneman in order to avoid the arbitration process. Rabbi Kahneman has been doing for years all he can to not hold the arbitration and all claims against the conduct of the arbitrators are recycled arguments raised even before the arbitrators themselves, and has been rejected. These claims are baseless."
