Agudath Yisrael kindergarten network will reimburse teachers who were fired with 4 million shekels

Regional Labor Court in Tel - Aviv last week had the gene network of Agudath Israel in a month to pay compensation of $ 4 million to 16 teachers, because they were fired illegally - without a hearing and the discrimination for their age.


The story begins more than 12 years ago; the kindergarten network of Agudath Yisrael found itself in a financial deficit. To recover from the difficult economic situation they built on a recovery plan, and which in 2003, they fired all the teachers who have accumulated more than 25 years of experience.

16 teachers, all in their fifties and sixties, argued that the network fired them, without having conducted a hearing, and the discrimination against because of their age. And as a result, they filed a lawsuit to cancel the dismissal. In their demand the teachers also claimed that the network paid them less wages then the teachers receive in formal institutions, and accordingly they asked for wages.


The court accepted the prosecution, Agudath Yisrael appealed - eventually rejected.


In 2011 the National Court explained the two main reasons that the teachers were fired illegally.

One reason - discrimination because of their age, because teachers were dismissed based only on seniority criterion, which has a strong connection to age, and the second reason - lack of hearing. The majority further held that since the network receives benefits from the state, it is obliged to pay the horticultural wage rate to its teachers as entitled to official institutions.


The case was returned to the District, so that it shall determine the amount of compensation that the network will have to pay for each kindergarten teacher.

Last Tuesday the judgment was given. Judge Natha Ruth determined that each of the kindergarten teachers will receive compensation of 50 thousand shekels for dismissal without a hearing and the discrimination. "Discriminatory conduct of the defendant failing against the plaintiffs of the worst kind."


The judge also examined the eligibility of teacher's for components such as wage differentials, severance Helena, severance pay, vacation pay and other rights in accordance with their work online. Eventually, the compensation the network has to pay for preschool teachers is 3,898,520.55 shekels. This amount includes attorney's fees in the amount of 387 thousand shekels.
