Is the Nesher struggle, located near Ramla reaching the courts?
Reciprocal action threatening letters were sent by the Association for the Prevention of desecration of graves and Nesher Israel Cement Enterprises Ltd., which accused the other parties of damage, injury - and threaten lawsuits in court.
The first letter, sent last Wednesday - by attorney Yisrael Gore, on behalf of Aharaleh Yekter, a member of the association to prevent desecration of graves. The letter was addressed to Yoel Feldshu, CEO of Nesher and Chezky Kalmanovitz, Director, Atra Kadisha.
The letter claims that Yekter, during the protest carried out in the quarry, was attacked and "private property" was stolen from him.
"My client made a legal protest, with the participation of two people only and outside a private area ..." writes Mr. Gore. "However security personnel on your behalf came in tracked vehicles of Nesher which were documented, attacked my client representatives brutality and violently and stole the sign he was holding. This was done in two separate times, yesterday and today."
In the letter Attorney Gore demands on behalf of Yekter the signs back to him or the equal amount of 1,170 NIS plus 20,000 NIS in compensation. "If you do not respond to the requirements above, I will recommend to my client to open legal proceedings against you and you will have to bear the costs and consequences."
"Private possessions" stolen from the demonstrators who came on behalf of the Association for the Prevention of desecration of graves, are the signs protesters held bearing the inscription:" Here and now hundreds of Jewish cemeteries are being evacuated for greed purposes."
In a response answering today (Monday) by Nesher, Tzachi Feldman, they reject the arguments presented in the letter of attorney Yisrael Gore. "My client denies all the allegations in your letter above and the aforementioned" it says. "Security guards spotted two people that my client has no idea who they are who were standing next to the factory at the edge of the city and next to them is a sign that says ... The security officer turned politely to them people and asked them whether the sign belongs to them. They responded that the sign is not theirs and my client representatives took the sign. This happened day after day."
The claims about the brutal attack written by Attorney Feldman: "they have no dawn and rejected out of hand." He explains that since the company representatives did not know who the sign belongs to and the owner was not in the area, my client is entitled to take the sign on the assumption that those who own the sign despaired of it since it has little value. Now, that we found out they belong to your client, he is invited to have them back."
Mr. Feldman also used the letter to answer the threat of a lawsuit against Yekter, "There is no dispute that the sign that my client operates evacuating Jewish cemeteries for money, is libel intent to harm. The attempt to attribute my clients operations for the 'Making of Money' is a vile attempt that has no basis in reality."
Nesher requires Yekter to place in the same sign, within three days, "for the same time period with a sincere apology published for the language of evil." In addition, the company requires him to pay within one week the amount of 100 thousand shekels for libel.
And if not? "My client will have to take all the proceedings at its disposal."
Yekter said in response to a counter-claim of Nesher: "Gradually it turned out that the sad and shocking compound 'Nesher' is actually a desecration of the graves of ancestors by orthodox people. If initially the Atra Kadisha denied their involvement, now they admit it openly, and justify this by clowning and lie. I'm waiting for a lawsuit of Nesher and for the moment it will reveal documents showing how graves belonging to Tenaim have been turned over and some have already been evacuated."
Activists of the Association to prevent desecration of graves, said that the protest began operating in recent weeks and will continue without interruption. "We will fight with all our might and with all means, until the moment it will stop desecration of graves at Nesher."
One of the activists also associated with the struggle emphasizes: "The letter of the law firm of Nesher, they deny it is done for money, but there is no denying the part about the fact that they were digging graves - and Atra Kadisha claim that it is their supervision. It is simply unbelievable where we've gotten to."
