Beis Din against the Civil Court.
Despite the court ruling in Tel Aviv, the Beis Din in Bnei Brak determine: The Heligman Synagogue is a public trust.
For years, the disputed building operated as a synagogue, donated by the father of the Heligman family, but his successors seek to turn the area into a shopping center or residential building.
The synagogue Rabbi, Rabbi Avraham Yeshayahu Karelitz and synagogue organization claimed that the building was dedicated to the synagogue and there is no requisition. After hearings in the District Court in Tel Aviv, the Court rejected the synagogue organization's claim three weeks ago, and required them to pay legal expenses of 15 thousand shekels.
Among other things, the court determined that the association should not be seen as a continuation of the synagogue society operated in the days when the synagogue was built.
In recent days the synagogue Gabbai learned that negotiations are being held between the family and businessmen to sell the building, subject to the court's decision.
Following this Hgr"n Karelitz's Beis Din convened and banned buying the place. "We are making it clear, this is Daas Torah", the letter read, "the area of the synagogue is a sanctuary place and it is prohibited to purchase it, and whoever does, lays his money on the alter."
The letter was signed by members of the Beis Din - Hagaon Silman, HaGaon Rosenberg, Hagaon Farbstein.
The Beis Din led by the Shevet Levi, HaGaon Wosner, and the Beis Din under the chairmanship of Hgr"m Shafran, signed the letter.
In the coming days Rabbanim and Gedolei Yisrael are expected to sign the letter.
However, the letter was not released yet and legal consultation is discussing whether to publicly post the letter or settle for transfer to all parties involved in the struggle of the synagogue.
Gabbaim of the synagogue, are currently engaged in formulating an appeal to be submitted to the court's decision. For this purpose, the services of one of the largest law firms in Israel have been hired.
