Concern: the court will not consider Rubashkin's appeal

The list of cases which the Supreme Court in Washington will hear was posted on the eve of Yom Kippur.

A study shows that the file of Sholom Mordechai Rubashkin sentenced to 27 years in prison, does not appear there. Never the less, his lawyers say: "There is hope."

On Monday, the time on which the Supreme Court Judges will return from recess, it will be possible to know definitively what the state of his file is, since then the list of cases denied will be published.

Also published will be another list of files which the judges wish to study again.

On Monday, the U.S. Supreme Court was supposed to decide if Rubashkin will be given an opportunity to file another appeal about the sentence, when this discussion is the last time the subject would be discussed in court.

At the end of a day of discussions it became clear to the lawyers and family members that six cases were confirmed to further appeal, but Rubashkin's case was not among the six, and was not raised at the hearing.

"Nothing can be determined, things will become clearer on Monday," said attorney Nathan Levin in a talk with VIN site. "There are cases that the Court wishes to examine again. It could very well be the case is examined more closely, or the judges want to hear more about it."

The option where the court decides not to discuss the case – is also there.

For the past five years prisoner Rabbi Shalom Rubashkin is languishing in an American prison, for the crime of employing illegal foreign workers and for money laundering.

After tens of discussions in the various courts Rubashkin was sentenced to 27 years in prison and a fine of 31 million dollars – a very puzzling sentence for the U.S. legal officials who claimed that there had never been such a heavy sentence for an offense of this sort.

The appeal was submitted to the court and it has not yet been determined what its fate is. This is the last hope of Sholom Mordechai Rubashkin.

In Batei Midrash and shulls in the U.S. and around the world there were prayers on this last Yom Kippur for Rubashkin.
