On Wednesday, the military court in Jaffa gave the sentence of Devorah Leah Cohen, a hareidi woman who was arrested nine days ago for defection from the IDF. An indictment was handed in, and according to the decision, she was sentenced to 50 days of jail.
From information which reached Behadrey Hareidim it seems that the main paragraph in the indictment is par. 94 of the military judicial law, whose meaning is unauthorized refraining from military service. Judge Orly Markman, deputy president of the military court, gave the severe sentence.
According to military arrest laws, the sentence comes into force from the day she was arrested. Therefore, the nine days of arrest which she has already served and five other days due to "shortening of punishment" have been reduced from the overall sum. Therefore 36 days of arrest are still in force.
The woman, who is a member of the Chabbad kehilla in Kiryat Malachi, was arrested after turning herself in when she came to the military police in Kiryat Malachi, since she and her husband planned to fly to New York to pay a visit to the tomb of the Lubavitcher Rebbe zt"l. They came in order to clarify her standing and receive an exit permit.
In previous hearings, it was claimed in court that the woman harmed the military discipline by declaring enlistment in the past, arriving at the induction center and escaping from it. It is not yet clear which legal procedures the family and attorney will use.
Last week, her husband, Eliran Cohen, related in a talk with Behadrey Haredim: "We came to the military police in our city, we innocently presented a marriage certificate in order to organize my wife's exemption from serving in the IDF, but for some reason it very quickly turned into an arrest. We didn't expect them to behave this way towards her".
