After years of failed attempts, the Knesset’s ministerial committee approved for voting the dramatic law initiated by MK Moishe Gafne (UTJ) which would allow Rabbinic Batei Dinim to judge civil monetary cases

After years of unsuccessful attempts: The legislative ministerial committee approved for debate and ultimately vote, a dramatic bill proposed by chairman of the finance committee, MK Moishe Gafne(UTJ). The bill which was approved this morning, will allow Rabbinic Batei Dinim in Israel to rule on civilian monetary cases- if both parties agree to go to Beis Din.

Once the law has been cleared by the ministerial committee, it can be brought for deliberation and vote on the Knesset floor.

The Religious and Chareidi communities have been trying unsuccessfully for decades to have the law passed. Unfortunately, they have always been stalled by the ministerial committee; which had repeatedly prevented it from even making it to the Knesset for debate.

With overcoming this impediment there is much hope that the bill will also pass its second and third reading in the Knesset, thereby rendering it law.

If the bill does in fact become law, it will create a dramatic increase in the power Batei Dinim hold in Israel, and they would now be allowed to Rule over civil monetary matters.

The Bill states, that members of communities living within Israel that wish to bring their monetary disputes in front of a Besi Din, can do so and the Beis Din’s verdict will be recognized by the state.

The bill also states that both parties have to consent in writing before the Beis Din can rule over their dispute.

Speaking to “Bechadrei Chareidm” MK Gafne who initiated the bill said, “this bill is a dramatic proposal. Many years ago, the high court ruled that Bati Dinim will not be allowed to rule over monetary matters, only over martial matters. Understandably it diminished the standing of the Batei Dinim. Over the years, both the Charedi and Dati Leumi camps, have tried to pass this law, but have not been successful…”

Gafne Explained that “in the past- the Chiloni community stood on its hind legs, not to allow us this option, even though one can choose if to go to a Beis Din or not-they did not want Batei Dinim to have such stature.

This was a decision made by the high court, and the Chiloni representatives strongly defended it throughout all the years, which left us no way of succeeding in any of the past governments, no matter how much we tried.

This time, for the first time ever, with Siyata Deshmya it was approved by the Ministerial committee”.

Gafne Shared with “Bechadrei Chareiedm” that he met with all the relevant parties in the government, and it B’’H brought great success. “I met with justice minister Shaked, together with Minister of religious affairs, David Azulay. There was also issues with the Department of Treasury, I held talks with them as well, and B’’H we were successful.”
