Will a government be formed in the coming days? Knesset legal advisor Eyal Yinon, published this evening (Sunday) a legal opinion stating that the nominating committee headed by MK Zeev Elkin does not have the authority to promote a change in the Basic Law that would allow the expansion of the cabinet.
According to Yinon's opinion, if the Knesset wishes to promote the law in a second and third reading before the government will be sworn in, it will have to form a special committee to discuss the matter. Due to the opinion the new government's swearing in will be postponed.
So too, Supreme Court Justice Daphna Barak-Erez instructed the Knesset and the Knesset's legal adviser to respond to the petition of Yesh Atid against the increasing number of government ministers until tomorrow at 8: 00 am.
Chairman of the faction Yesh Atid, Ofer Shelah, petitioned the High Court against the government's decision to increase the number of ministers and to change the Basic Law and a request for an interim injunction to stop the legislative process undertaken by the transitional government. "We submitted a petition to the High Court to stop the deplorable procedure," Shelah wrote.
The petition stated that "This petition is served in haste and urgency with the aim of preventing the trampling of democratic principles in our system of old practices in general and the breach of the Knesset Law.
"We have before us a cynical plot, of a change of rules in favor of self-preservation and lust for power, as expounded by the Prime Minister, who wishes to place a turning sword, in the form of loyalty test before swearing, over the heads of 61 members of the legislative who are supposed to take part in the coalition headed by him, when he believes the chairman of Knesset would assist him in achieving what he wants, while trampling the delicate texture and balance between the legislative and executive branches; This is a political outrage, which will cause serious, critical and irreparable harm to the status and dignity of the Knesset and one of the lowest moments of the legislature".
As stated, the Knesset and the Knesset's legal adviser should respond to the petition until tomorrow at 8:00 am.
Former Health Minister and present MK Yael German, said in an interview with Avi Mimran this evening on Kol Hai radio station: "I petitioned against Litzmann's appointment as deputy minister for a fundamental reason, and not because he is not professional. We were wrong in our dealings with the haredim in the issue of the draft law".
