Zealots petitioned to High Court: stop the construction at Golobnzitz site

Zealots may not recognize the state, but it turns out that they are familiar with the institutions, and use them: Moshe Friedman, a member of Eideh Charedi presented today (Monday) a petition, which sought an interim injunction order the cessation of work at the Golobnzitz site in Beit Shemesh. The petition was filed by attorney Itamar Ben Gvir.

The petition argues that work on the site began this morning are in violation of the law. "There are a number of solutions according to Jewish law allow minimizing the damage in tombs, on the other hand allowing the continued construction," he explains. "Teachers of the law and case law clearly when there is damage to the graves that everything must be done to select the solution that will reduce the harm."

The petition is filed against the Israel Antiquities Authority, the Golobnzitz brothers, project developers, and more and is referenced in the judge's opinion of archaeologists concluded in the past that undoubtedly exist where there are graves. In addition, Ben Gvir added an opinion under halachic ruling stating that there are solutions to the problem of graves, inter alia, raising the construction using a floating floor – which would leave space between the graves and the ground.

Attorney Ben Gvir surveyed the rulings of the Supreme Court in several decisions of teachings in balance when values collide. "There must be a solution," he said in a conversation with B'Chadrei Charedim. "Petitioner asked the court to order the cessation of work so that parties will find a satisfactory solution."

The petition itself has no reference to conflicts and internal disputes within the Eideh Charedi against the organization Atra Kadisha. "Our goal is to stop the work because they are illegal, these works have a defect in the law and that is enough. It is an outrage and they should stop it."

Petitioner, Moshe Friedman, previously filed a petition along with two other avrechim against builders in the apt complex in Jaffa, where requested to issue an order to stop construction immediately. Court dismissed the petition but it made great headache for project developers.
