The 'Neturei Karta' man who allegedly offered to spy for Iran against Israel, was brought the morning (Monday) for a remand hearing.

During the hearing it was revealed that the defendant turned about 20 years ago to the Libyan embassy in a European country, and sought to acquire a passport of the country and immigrate to it - several years after he was discharged from military service due to incompatibility.

His attorney, Yair Nehorai, said during the hearing that his confession at the GSS is not admissible since he did not see a lawyer. Likewise, he also asked to keep his identity confidential, since he is not mentally competent.

District Court of Jerusalem Judge has extended the detention of a suspect by two days.

Attorney Ezra Rachmani, state representative, told the Jerusalem District Court that the evidence is allegedly based on the respondent's admission, during several investigations in which he was interrogated.

"In addition to these messages, pictures were found in the defendant's camera and home as well as in his cell phone. The pictures include the note given to him by the Iranian embassy by the same Iranian officials with the details of an email box, a picture of his ticket to Germany, a picture of the flight schedule of the day of flight, pictures of hotels about which he inquired, a map of Berlin as well as details of the Iranian embassy in Frankfurt.

"In addition, the respondent's passport which was seized bears stamps indicating exit from and entry to Israel. During his interrogation the respondent entered through his cell phone to the email box according to the details provided him and there was an indication that the box existed, but was discontinued. In addition, a replication with the respondent was done in which he indicated the public phones from which called the Iranian embassy and pointed to the Internet - cafe where he worked.

"The investigation was in cooperation of ISA and investigation. At the start of the investigation the respondent was prevented from meeting with a lawyer. Prevention was removed and from that moment the respondent consulted with attorney Leah Zemel several times during the investigation, and this right was completely fulfilled.

"I heard my colleague about the respondent's state of mind: the material does not indicate that the respondent has some mental problem, certainly not one denying the possibility of such indictment. The respondent was specifically asked about this and therefore we believe that such a check is not necessary.

"Beyond the written notifications there is a large photo of the captured images in the respondent's cell phone. I will add that the images which were caught list the date, the name of the image is the date from the date of travel. The respondent was arrested on 7/17/13 and the open investigation began on this day. At the time there was an order prohibiting and preventing a meeting, which was later removed. He even asked to remove the gag order totally.

The suspect's attorney Yair Nehorai argued that the arrest was made at 6:20, but from a memoir presented it stems that "there was an appeal to the Public Defender but they say they began the investigation at 11:25 as they saw the urgency that and since the Public Defender did not answer the phone. While the reality is, that he actually passed the initial investigation which also broke him. The document that the court has in which the police as if explains, the bottom line is that the right and proper procedure was not done legally to turn to the public defender.

"He says he feels like a prisoner X, lonely and alone, when this is not the reality," added the lawyer.

His lawyer asked not to publish the name of the defendant and said: "We brought three witnesses here to testify, inter alia, on the condition of mind of the respondent. Since he is a member of Neturei Karta, people who do not go to doctors, so there are internal treatments. There is an extreme situation here and he should go for observation. If the court ultimately decides he is not normal, so I will have a real argument for publication. Until I have that, I think that one should give him the opportunity for the ban. I would like to delay publication until we see what his state of mind is. If this person is crazy, there is protection of the law on advertising. "

Attorney Ezra Rahmani responded to that: "He was secular in the past and served in the army. He claims he was discharged due to mismatch after his friends advised him to ask for it. "

As noted, the hearing of the matter was postponed by Judge Yaakov Zaban to the 08/07/13, at 08:30.
