Supervisor poured boiling water • sentenced to 5 months in prison

Kashrus Mashgiach, Beitar Illit resident and father of 14, was regularly humiliated by the victim • After a period of provocations, he poured boiling water on him and caused him severe burns on his face

Jerusalem Magistrate's Court imposed today (Monday) a sentence of five months imprisonment on a kashrus supervisor, married with 14 children who lives in Beitar Illit, who poured hot water on the face of another person at work, causing burns and serious injury to his face.

Judge Eitan Kornhauser wrote in his decision: "Violence is a harsh and dangerous phenomenon, which took hold in the public's routine. In order to eradicate this phenomenon, the Court expressed its position many times that one should cast deterrent punishments, while giving debut to the public interest and considerations of reward."

The complainant's testimony indicates that he worked with the kashrus supervisor in the same workplace, used to beat the defendant's neck, a hit called "Naiman" whenever he had a haircut, something which the defendant sought to stop him from doing. However, he noted that it is a practice used in the workplace and he did that even to the owner. The complainant denied the issue of humiliation and harassment to the accused.

A person who worked in the factory where the defendant and the complainant worked, testified that the complainant frequently bullied the defendant on a daily basis for at least eight months before the event. The complainant used to insult the defendant and others at the workplace, talk rudely, while the defendant did not respond.

The defendant testified that the complainant bothered him for four years in a systematic way: "Many times he did so, taking his pants off and saying these words, and it was almost every morning, he told me: they told you today these words already? That was his good morning."

The defendant argued that the complainant used to beat him on the back of the neck. Although he warned him several times not to repeat this, the complainant repeated his actions. The defendant argued that on the day of the event the complainant called him "old man, you're not worth anything." According to the defendant, he warned the complainant several times that he would pour boiling water over him if he would repeat his actions, and after a complaint referred to the owners of the place did not help: "I went, I heated some water for a minute or two, and ran to pour it on him."

The defendant expressed deep regret and testified that if he had known what damage this will cause to the complainant, he would not have performed it.

The judge sentenced him to five months in prison, after two days of detention. Eight months in prison the accused would not serve, unless he passed violence offenses within 3 years of release. Four months in prison which the accused would not serve, unless he transgressed within 3 years of release misdemeanor offenses of violence, and a compensation of NIS 8,333 to the complainant.
