precedent • Supreme Court in Sydney, Australia, overturned the judgment of the rabbinical court in the city, in a lawsuit of an Israeli citizen against a local resident • "Dayanim tilted the law"
- Yoel Bitelman, B'Chadrei Charedim
- כ"א סיון התשע"ג
The Supreme Court in Sydney, Australia, dismissed the verdict of the Rabbinical Court in Sydney.
Supreme Court judge in Sydney yesterday nullified judgment of the Rabbinical Court in Sydney which ruled Benjamin Amzalag - Haredi businessman, owes an Israeli businessman $ 300,000 for the sale of shares in a company.
In a reasoned judgment covering 80 pages, Judge Monica Schmidt judged in favor of Amzalag who owns the company "Ruffles Capital" - contrary to the judgment of the rabbinical court.
In 2010, the Rabbinical Court ruled that Amzalag must pay Shlomo Teller - a resident of Israel - the sum of three hundred thousand dollars. But Amzalag refused to comply with the ruling.
After some time the rabbinical court decided to indict him with a "refusal." Amzalag went to court claiming that the judges were hostile and tipped the law.
The judge agreed that indeed one of the judges, Rabbi Yoram Ulman tilted in favor of Teller. The Rabbi was heard saying in Yiddish, "I am convinced, but give Amzalag time to give answers."
