The Beis Din of Eida Haredim was required this evening (Thursday) to discuss a lawsuit filed by Rebbetzin Zipporah Markowitz against her mother, Rebbetzin Kahaneman, widow of President of Ponevez Yeshiva Rabbi Avraham Kahaneman, about the plot known as 'Ponevez Forest' sold to Satmar Hassidim in Bnei Brak.
The Ponevez Forest, located on the Admor of Gur street, between the building formerly used by the Beis Din of Hgr"n Kerlitz and the Ponevez yeshiva ketana, is private property that belonged to Rabbi Kahanman - bequeathed to his wife the Rebbetzin. Following negotiations with the management of Satmar housing - located in close proximity, the land was sold to them in exchange for about five million. According to rumors, the revenues are earmarked for the benefit of the Ponevez yeshiva.
However, some of the factors involved in the affair, claim that in fact the deal has not yet been closed, and it is under advanced negotiations. Satmar, who suffer a severe housing crisis, seek to establish a project in the area in question, which will entail dozens of apartments, and merge with existing housing.
Here the Markowitz family's anger jumped at the Kahanemans. Rebbetzin Markowitz wanted to open a file in the Beis Din of the Eida Haredis and to seek an injunction against the deal. It is not yet known what were the motives that justified such a claim, since as said, this is private property belonging to the widow, and her children do not have a right to it.
Rebbetzin Markowitz was represented by a few functionaries, and the issue was discussed by a panel which included the Ra'avad Hagaon Rabbi Moshe Sternbuch and Hagaon Rabbi Moshe Yurovitch.
On behalf of the Kahneman family, no one was called and no one appeared at the hearing.
Members of the Beis Din asked the plaintiffs to show the will written by Rabbi Kahaneman before they consider the claim. Behadrey Haredim has learned that after they saw its contents, members of the Beis Din realized that the petition should be dismissed outright, and so they ordered. "We have no just cause to intervene", the Badatz set.
"Even so, there was no point to the claim, since according to Jewish law one goes according to the defendant and the plaintiff did not ask in advance whether Kahneman family living in Bnei Brak, is willing to litigate in Jerusalem," add acquaintances of the family.
