Montreal: Beis Midrash of Monkatsh won't close

Victory ot Munkatch Hassidus in Montreal: judge approved the continuation of prayers in the shull of the community.
Alexander Warzberger, leader of activists in the Beis Midrash "Minchas Elazar" of Mukatch, Montreal, could finally smile last Friday.
The District Court ruled that even though the Beis Midrash which has been active for the past 35 years, is illegal in terms of the designation of its location, he approves the continued use of it for prayer and study.
Montreal National Post newspaper reports that following a campaign by neighbors of Beit Midrash, a police complaint was filed that the synagogue operates within a designated residential duplex, but was converted without a license to an urban public building.
For years, a group of neighbors has been trying to bring to the closure of the synagogue for various claims.
Several years ago, the group filed a complaint with the police that the study is causing a noise.
Neighbors asked police to close the Beis Midrash immediately.
The issue came to court and the threat of closure hung over the shull.
A week ago, the Supreme Court rejected the demand and decided that this are extenuating circumstances, and that the blind extraction of the law, irrespective of special circumstances, will result in injustice.
Alexander Warzberger said: "This is the victory of justice, it is a matter of persecution and anti-Semitism, I hope that the persecution of the neighbors against the Beis Midrash stop immediately."
THe group of neighbors and the municipality announced that they will test the ruling and will appeal against it.
