Reasoned letter sent by Movement for Government Fairness to Prime Minister argued that the complex procedures required in the Chief Rabbis selection process - require to open them now

Complaint: are the elections for the Rabbinate being neglected?

Prior to elections of chief rabbis of Israel, chairman of the Movement for Government Fairness, Attorney Mr. Mordechai Eisenberg, sent a letter on the subject to the Chief Rabbinate Council, Israeli Prime Minister Benjamin Netanyahu, Knesset Chairman Yuli Edelstein, and Deputy Minister of Religious Services Rabbi MK Eli Ben Dahan.

Question in his letter: "chief rabbis election process and the Chief Rabbinate Council - the next failure."

In his letter, Mr. Eisenberg writes the following:

"Around the pollution storm, everyone is stirring the elections of Chief Rabbinate of Israel. Everything is included, each one in his power of his imagination, it seems that there is not a day without news like fresh rolls. Idea legislation in each direction, as the hidden or visible desires of the bidder, proposed and offered. Hands of the tailors are overworked. "

Unfortunately, there is no truth and respect for Chief Rabbis is lost for all to see, even by those legally elected for the role.

"But it seems the main thing is missing from the book that seems to have forgotten the existence of a valid legal framework to the Chief Rabbinate of Israel and the ways of her election, legislative framework which all are required to do that. Law of Chief Rabbinate of Israel Law 1980 (" Rabbinate law ").

"Chief Rabbi Law stipulates the details of the selection procedure and the date to hold the elections of chief rabbis of Israel, the Chief Rabbinate Council - not later than one month prior to the expiration of their term of office.

"Rabbis current term ends (after the Knesset recently extended this term by four months), on 17th Av תשע"ג, 24/07/13 deliberated. It follows that elections should be held on 24/06/13 at the latest. According to the custom determining the day of the Election Day on Tuesday. Therefore it should be determined that Election Day should be held on Tuesday 10th Tammuz תשע"ג - 18.06.13. On this date should be held Chief Rabbinate Council elections (in the writer's opinion it is right and proper to combine the elections to the status of honor and glory and for efficiency reasons).

"This is therefore a period of approximately 54 days (including weekends and holidays.) To allow the election this has to establish the Election Commission and the Electoral Assembly, amongst others:

A. The Chief Rabbinate Council to select two representatives to the election committee.

B. The government of Israel to choose two representatives to the election committee.

C.. The Minister and the Chief Rabbis alike, with government approval, to appoint the Chairman of the Election Committee.

D. The Chief Rabbis of Israel, in consultation with the Minister and with the approval of the Government, appoint ten rabbis to the Electoral Assembly.
E. The Minister, in consultation with the Chief Rabbis of Israel and with the approval of the Government, appoint ten public figures Electoral Assembly.

F. The government must choose two representatives of the Electoral Assembly.

G. On the entry to select five representatives of the Electoral Assembly.

H. The Elections Committee to approve the list of members of the Electoral Assembly.

I.. At least 21 days before the election to be published in the list of members of the Electoral Assembly records and discuss objections if any.

J. The Election Commission notify all Member Electoral Assembly of his membership.

K. The Election Commission to set the date and place of holding of the elections in Jerusalem and published in the Official Gazette.

L. The Election Commission to receive up to seven days prior to the election the various nominations and discuss their qualifications in consultation with the Chief Rabbinate existence and confirmed or rejected.

"It is obvious that it is almost impossible that these tasks take place in such short unless we go urgently go out. The public is wondering whether neglect of the assignment treatment is done intentionally.

Therefore we appeal to your honor each person shared powers and procedure, to promote the existence of the procedure as much as possible so as not to be determined fact "passively" that will not be possible to hold the elections as scheduled of Chief Rabbinate of Israel legally."

Copies were sent to Attorney Eyal Yinon, the Knesset's legal adviser, attorney Yisrael Pat Attorney Ministry of Religious Services and Yaron Katan legal advisor of the Chief Rabbinate in practice.
