The court to Jerusalem municipality: Cancel the program for prevention of Chazara Beshealah

The court suggested the opposition member Meir Turgeman to pull the petition against funding prevention activities of Chazara Beshealah, but ordered an injunction against the implementation of activities • The injunction will be in effect until the municipality officially cancels the budgeting • If not canceled – Turgeman could appeal again to Court

The court to Jerusalem municipality: Cancel the program for prevention of Chazara Beshealah

The Jerusalem District Court on Thursday recommended that City Council member Meir Turgeman cancel the petition filed against the city for the decision to purchase the service for prevention of Chazara Beshealah from the Romema Community Council for 49,000 shekels.

However, the judge ordered in his decision, that if within three months the municipality will not reach a decision which will cancel the purchase of the service, Council Member may resubmit the petition to court.

Recall a few weeks ago, the court discussed the petition of the council member from the opposition, and issued a temporary decision that prevented the municipality to make the decision.

"Temporary order will be restored as an order to cancel the interim decision," wrote Chief Justice David Cheshin. "If within three months of cancellation of the decision of the Council, the interim order will stand for 30 days, and if within those 30 days, the application shall be submitted to hold a hearing on the petition - then the interim order will be in place until a ruling on the petition."

The parties agreed to the decision, and probably Jerusalem municipality will have to cancel the funding in question - designed to help youth drops out and block phenomenon of Chazara Beshealah, otherwise, Turgeman plans to pursue legal rights again, because, he says, "It is not the role of the municipality, and beyond that there is no authority to the municipality, to run or to fund a program designed to prevent Chazara Beshealah or leaving religion."

The one who represented the opposition member is Yossi Chavilio, who once served as legal counsel for the city, and he relied on his petition against judgments which can be learned that the city's legal authority to allocate funds for such purposes.
