Haredi family of 13 has been thrown into the street and started a hunger strike: Administrator General Ministry of Justice ordered yesterday (Monday) to remove the Shababo family from their apartment in the Old City of Safed. Father, Rabbi Yosef Shababo: "We were left with 11 homeless children; we are relying on the mercy of Heaven."
The beginning of the story, 32 years ago, Shababo decided to expand a two and a half bedroom apartment that was in his possession. The property located near his apartment the size of a room and a half was a good opportunity for him to expand his small home for his growing family. "We wanted to have a place to feed our children like human beings," says the father in a conversation with B'Chadrei Charedim.
But then it turned out that the property which Shababo wanted to use was administered by the Administrator-General at the Ministry of Justice because of the fact that the landlord is absent. To complete the purchase process, Shababo bought the extra apartment using tab fees, giving him possession of the property.
In 2010 a lawsuit filed by the Administrator General Magistrate's Court in Afula where the father was demanded to pay rent on the apartment for all the many years he used it and also asked the court to issue an evacuation of the family from the apartment.
Prosecution was conducted for two years and in early 2012 the parties reached an agreement whereby Shababo shall pay one-time rental fee of 8000 shekels plus 800 shekels a month rent from then on. The court approved the agreement between the parties.
Shababo, it turns out this week, did not understand the significance of the agreement, had not paid the required and subsequently a file opened against him in the execution.
Yesterday at 11 am, police arrived accompanied by execution, removed Shababo, his wife and 11 children out into the streets of the city. "We have nowhere to go. We were thrown into the street," said the pained father to B'Chadrei Charedim. "All the equipment we had in the apartment was thrown into the street. I have 11 children left homeless. We are at the mercy of Heaven. We tried to reach a compromise with the Administrator General, but without success."
Lawyer. Jalal Halehel, representing the family since the evacuation, contacted the Peace Court Afula with a request to delay the eviction process, "My client did not invade the apartment, he took possession of as a renter in accordance with the verdict," he told B'Chadrei Charedim. "The tenant was removed from the apartment for not paying a symbolic fee."
Ministry of Justice on behalf of the Administrator General and Official Receiver's response to B'Chadrei Charedim: This property is managed by the Administrator General in trust for private owners, in accordance with the Administrator General, תשל"ח - 1978.
"The property from which they were vacated is not the Shababo family's apartment, but the apartment attached to it which was invaded, after they broke the wall between the apartments. Administrator General was forced to file a lawsuit on behalf of the private owner to evacuate the invaders from the apartment. In this process the Shababo family was represented by an Attorney.
Argument that attempts to end the procedure by way of compromise have failed is incorrect. The parties reached a settlement agreement, which has been validated by a judgment which was given to the Shababo family, at their request, the possibility to stay in the property against the payment of rent and agreed that if the rent is not paid, they will be evacuated from the property.
Since rents the Shababo family undertook to pay according to the settlement agreement is not paid for, the evacuation Property Administrator General operated in accordance with the judgment. It should be noted that all along, both during and after legal proceedings Administrator General tried to reach understandings with the Shababo's but to no avail.
"The evacuation was carried out lawfully and came after the Shababo family received an evacuation alert already in October 2012. Despite this the Shababo family did not act as required by law, the evacuation of the property, so they cannot complain about the time of the evacuation, but to themselves. It is worth noting that the Administrator General manager of eviction is holding another eviction in another area in Safed, and which is also managed by the Administrator General."
